Terms of Service
Welcome to OctoCoach. By using this application, you agree to these Terms of Service. Please read them carefully.
1. Acceptance
By creating an account or using OctoCoach, you confirm that you are at least 18 years old and agree to be bound by these terms.
2. The Service
OctoCoach is a personal mental-game coaching tool for poker players. It provides session tracking, hand logging, opponent notes, and AI-powered coaching guidance focused on mental performance and reflection. OctoCoach does not facilitate, accept, hold, or process wagers of any kind. OctoCoach is not a gambling operator under any jurisdiction and does not encourage or promote gambling activity. Compliance with gambling laws applicable in your jurisdiction is solely your responsibility. The home game manager is a calculator and record only. OctoCoach does not organise games, hold money or take fees. Do not use it to collect a rake, an entry fee or any profit for the host; shared costs are only for splitting what food and drinks actually cost.
3. Subscriptions and Cancellation
Pro features are available through a paid subscription. Payments are processed by our merchant of record. Subscriptions auto-renew until cancelled. You may cancel anytime from the Settings page; cancellation is effective at the end of the current paid period. Residents of jurisdictions with statutory cooling-off rights (including Israel - 14 days for distance contracts) retain those rights as provided by law.
4. User Conduct
You agree not to use the service for any unlawful purpose, to abuse the AI coach, to attempt to reverse-engineer the application, or to enter data about identifiable third parties without a lawful basis to do so. Notes you write about opponents are stored under pseudonymous identifiers and are not linked to verified third-party identities.
5. AI Coaching - Nature of Outputs
Outputs of the AI coach are educational and reflective in nature. They are not professional advice - financial, medical, psychological, or legal - and must not be relied upon as such. AI outputs may be inaccurate, incomplete, or outdated. You retain sole responsibility for all decisions, including any involving real money. OctoCoach is a coaching aid, not a substitute for professional help when you need it.
6. Limitation of Liability
To the maximum extent permitted by law, OctoCoach's aggregate liability for all claims arising out of or related to the service shall not exceed the amount of fees you paid in the twelve months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, special, or exemplary damages, or for lost profits or lost data, even if advised of the possibility. Nothing in this section limits liability that cannot be excluded under applicable consumer protection law.
7. Age Misrepresentation
If you misrepresented your age at signup, your account is voided immediately upon discovery. All associated data is subject to deletion, and any fees paid are forfeited (subject to non-waivable consumer rights under applicable law).
8. Governing Law and Disputes
These terms are governed by the laws of the State of Israel. Disputes shall be brought before the competent courts of Tel Aviv, Israel, unless a non-waivable consumer protection right grants you a different forum (typically the consumer's place of residence in the EU). Nothing in this section limits your statutory rights as a consumer.
9. Termination
You may delete your account at any time via Settings. We may suspend access for users who breach these terms.
10. Changes
These terms may change. Material changes will trigger a re-consent prompt the next time you open the app.
